Why You May Need More Than a Last Will and Testament To Cover Your End-of-Life Decisions

About 40% of American adults have a Last Will and Testament. Having this document may put you ahead of most Americans, but it will not ensure that all of your end-of-life wishes are met.  Here are some important life elements that you need to address separately from your Will in order to ensure all your bases are covered.

Healthcare Directives

According to AARP “every adult should have an advance directive in which you explain the type of healthcare you do or do not want when you can’t make your own decisions.” You should have someone appointed to make sure that your wishes are carried out. You will need special documentation outside your will to make sure your healthcare wishes are carried out.  We recommend a separate Healthcare Power of Attorney, a Universal HIPAA Release, and a Directive to Physicians. 

Funeral Instructions

Funeral instructions can be covered in your will however they may not be properly implemented. Wills are often read days or weeks after a person passes away, and your instructions may not be viewed until long after the funeral is over. It is often better to prepay for your funeral or to buy funeral life insurance.  This takes a heavy load off your loved ones and ensures they’re not making difficult decisions during an emotionally-charged time.

Gifts to Pets

With many adults owning pets it might not be a surprise that many want to leave behind a plan for them. This ensures your furry friends are properly transferred to another owner and cared for the way you want and intend. 

OTHER DOCUMENTS YOU SHOULD HAVE ON FILE

 If you are to become incapacitated or pass away your loved ones will want to make sure they respect your wishes. You can make this easier by storing your documents in a safe place and informing your loved ones of that place. 

Directive to Physicians

A Directive to Physicians is a legal document that describes your medical wishes in that case that you could not perform them due to poor mental or physical health. You can decide if you want to be kept alive regardless of the quality of life, or if you prefer to be not in pain and let go. This may also be referred to as a Living Will.

Health Care Surrogate Designation

This will be the person who serves as your Healthcare Power of Attorney. They will carry out your healthcare decisions in the event you are unable to handle them yourself.

A Letter of Last Instruction

    This document proves invaluable to the event of death. It covers wishes pertaining to your funeral. It also lists the locations of safety deposit boxes, tax information, and other personal papers that will be needed.
